New Swiss data protection law - an event provides clarification

As is well known, Switzerland is also facing a new data protection law: What is the difference to the EU General Data Protection Regulation (GDPR)? An event organised by the SAQ provides clarification.

Parliament adopted the totally revised Swiss Data Protection Act (DPA) on 25 September 2020, paving the way for the replacement of the 1992 Act, which is still currently in force. Due to rapid social and technological developments, it has become necessary to press ahead with the modernisation of the outdated DPA and to ensure its adequacy in comparison with the EU.

The EU's General Data Protection Regulation (GDPR), which has been applicable since 25 May 2018, has posed new challenges for internationally active Swiss companies and additionally increased political pressure on the Swiss government.

Most important innovations

In her compact presentation, Maria Winkler, attorney-at-law, outlines the most important innovations of the DPA revision. With practical examples, explanations of terms (e.g. duty of disclosure, profiling, privacy by design, etc.), possible stumbling blocks and challenges in the application of the new DPA will be highlighted, but also significant differences to the EU GDPR will be addressed. With the concrete recommendations and tips, the participants can already prepare themselves for the upcoming requirements of the new DPA and look forward to the entry into force of the new law.
 
Maria Winkler is the managing director of IT & Law Consulting GmbH. With her team, she advises companies in the areas of data protection, IT contract law and records management. In addition, she works as a data protection officer for several companies, auditor for data protection certifications and lecturer at various universities of applied sciences.
